Saunders looks at questions of copyright and changes to the law in France, considering work by Thompson, Whale, Edelman, Hirst and Althusser. He describes a copyright crisis over the nature of photography and how understanding of the photographic image shifted, from the idea that photographers merely provided an accurate reproduction of reality to the notion that they were involved in an original creative activity and therefore had rights in the fruits of that activity. Considering subsequent debates over copyright in software, Sanders asks whether every choice can be considered a matter of creative originality and hence susceptible to copyright laws.
